Agreement to Terms
By downloading, installing, or using the Eliminate mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Eliminate LLC, a Pennsylvania limited liability company.
What Eliminate Is
Eliminate is a personal finance management tool designed to help individuals track credit card balances, log transactions, and plan debt repayment. The App is a productivity tool only.
Eliminate is NOT:
- A financial advisor or investment advisor
- A bank, credit union, or financial institution
- A credit repair service
- A debt settlement or consolidation service
- A licensed financial planning service of any kind
Nothing in the App constitutes financial advice. All information, calculations, and projections are for informational and planning purposes only. You should consult a qualified financial professional before making any financial decisions.
License to Use the App
Eliminate LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You may not copy, modify, distribute, reverse engineer, or use the App for any commercial purpose without written permission.
Subscriptions and Payments
Free Tier
The App is available free of charge with limited features including up to three credit cards and basic transaction tracking.
Pro Subscription
Additional features are available through a paid Pro subscription:
- Monthly: $2.99 per month
- Annual: $24.99 per year (billed annually)
- Lifetime: $39.99 one-time payment
Pro subscriptions are processed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
Refunds
All purchases are subject to the refund policies of the Apple App Store or Google Play Store. Eliminate LLC does not process refunds directly.
Free Trial
A 7-day free trial of Pro features may be offered to new users. You will not be charged during the trial period.
Your Data and Device Transfers
Local Storage
All financial data you enter into the App is stored locally on your device. Eliminate LLC does not have access to your data. You are solely responsible for maintaining backups.
Upgrading or Replacing Your Phone
Important: Read this section carefully before upgrading or switching to a new phone.
Because your data is stored locally, what happens when you get a new phone depends on how you transfer:
- iPhone to iPhone via iCloud or iTunes backup: Your app data will typically transfer automatically.
- Android to Android via Google Backup: Your app data will typically transfer automatically.
- Setting up a new phone as a NEW device: Your app data WILL BE LOST. Export a backup first.
- Switching from iPhone to Android or vice versa: Your app data WILL BE LOST. Export a backup first.
Before upgrading, switching, or resetting your phone, export a backup from the App's Settings tab and save it somewhere safe such as iCloud, Google Drive, or email. Eliminate LLC is not responsible for data loss resulting from device changes.
Deleting the App
If you delete the App, all data stored by the App will be permanently deleted. Eliminate LLC cannot recover this data. Always export a backup before deleting the App.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. ELIMINATE LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ITS CALCULATIONS OR PROJECTIONS ARE ACCURATE OR SUITABLE FOR YOUR SPECIFIC FINANCIAL SITUATION.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELIMINATE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES INCLUDING FINANCIAL LOSSES, DATA LOSS, OR ERRORS IN CALCULATIONS. IN NO EVENT SHALL ELIMINATE LLC'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Not Financial Advice
All debt payoff calculations, interest projections, and budget recommendations are based on the data you enter and standard mathematical formulas. They are for informational purposes only. Eliminate LLC is not a registered investment advisor, financial planner, or credit counselor.
Governing Law
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in the courts of Pennsylvania.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or by updating the effective date above.
